Terms of Service

1. Acceptance of Terms

By accessing or using LaunchBuff at launchbuff.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms apply to all visitors, users, and anyone who submits a product or accesses any feature of the Service.

2. Description of Service

LaunchBuff is a product discovery and tournament platform. Users can submit products, vote in head-to-head community matchups, and earn winner badges. The Service includes a product directory, tournament brackets, leaderboards, and a blog. Certain features require account registration.

3. Accounts

  • You must provide a valid email address to create an account.
  • You are responsible for all activity that occurs under your account.
  • You must not share your login credentials or allow others to access your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.
  • You may delete your account at any time by contacting us at [email protected].

4. Product Submissions

By submitting a product, you represent and warrant that:

  • You are the owner of the product or have authority to submit it on behalf of the owner.
  • The product and all associated content (name, tagline, description, logo) do not infringe any third-party intellectual property, privacy, or other rights.
  • The information you provide is accurate and not misleading.
  • The product does not promote illegal activity, hate, violence, or adult content.

We reserve the right to reject, remove, or delist any product submission at our sole discretion, including for violations of these Terms or our community standards.

5. Voting Rules

  • Each registered user may cast one vote per matchup.
  • Voting manipulation, including use of bots, multiple accounts, or coordinated inauthentic activity, is strictly prohibited.
  • We reserve the right to invalidate votes and disqualify products that engage in voting manipulation, without refund or compensation.
  • Voting is available only to users who have submitted a product on the Service.

6. Winner Badges

Tournament winner badges are awarded to products that achieve the highest community vote count in a given bracket round. Badges are non-transferable and tied to the specific product and tournament cycle in which they were earned. LaunchBuff retains the right to revoke a badge if the winning result is found to have been obtained through manipulation or fraud.

7. User Content

By submitting content to the Service (including product descriptions, logos, and any other materials), you grant LaunchBuff a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that content in connection with operating the Service.

You retain ownership of your content. We do not claim ownership of any content you submit.

8. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Harass, threaten, or harm any person through the Service.
  • Scrape, crawl, or systematically extract data from the Service without our written permission.
  • Attempt to gain unauthorized access to any part of the Service or its underlying systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Submit false, misleading, or spam content.

9. Intellectual Property

All content, design, code, and functionality of the Service that is not user-submitted is owned by or licensed to LaunchBuff and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the fullest extent permitted by law, LaunchBuff and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the greater of (a) $100 USD or (b) the amount you paid us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless LaunchBuff and its owners, employees, and affiliates from any claims, losses, liabilities, damages, and expenses (including legal fees) arising from your use of the Service, your content submissions, or your violation of these Terms.

13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the effective date and, where appropriate, by email. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be subject to binding arbitration or the courts of competent jurisdiction in the applicable territory.
